1. ORGANIZER The “Scratch, Authenticate and Win” contest is being organized by Lux Industries Limited, India (hereinafter referred to as the “Organizers”) in association with Yellow Flower Trading Company, LLC, a wholesaler company of Lux Products and registered and having its headquarters in Dubai.

2.1. The “Scratch, Authenticate & Win” contest (henceforth called the “Contest”) shall begin on the, 15th of October 2013 and shall be for such period till which the stock of the Organizer lasts. The Organizer shall have the sole discretion of deciding the time period of this Contest.

3.1. All participants undertake that they have read these terms and conditions carefully and fully understand the same.
3.2. By participating in the contest, the participants agree to be bound by the terms and conditions of this Contest and agree:
a) To receive SMS communication from the Organizers on their mobile phones relating to the Contest.
b) To receive information, offers and deals regarding the company products or contests.
3.3. The Organizer reserves the right to cancel or amend the offer and the Terms and Conditions at any time. Any changes will be posted on the Organizer’s website i.e.
3.4. By participating in this Contest, the Winners consent to the following:
a) For the winners name and / or photograph to be published for promotional or marketing purposes including Press, TV, OOH, Online promotion, Ground Activation, Radio and across 360 deg marketing platforms.
b) for the Winners name to be disclosed to any person requesting that the Organizer confirm the identity of the Winner
3.5. This Agreement will remain in force for the entire period for which the Organizer runs the Contest.

4.1. The Contest is open only to the buyers of Lux Products, residing in Nigeria and Ghana
4.2. The Contest is open for people belonging to all age groups.
4.3. The Organizers, the suppliers of goods or services in connection with this Contest and their respective spouses and/ or business partners or associate and their immediate family members are barred from participation in this Contest.
4.4. The Organizer reserves the right to disqualify any participant if it has reasonable grounds to believe that the participant has breached any provisions of the Terms and Conditions.
4.5. By participating in this contest the participant warrants that all information provided by him/her is true, correct and complete.

5.1. A participant can enter this Contest only by purchasing Lux products. Upon purchase of a genuine Lux product, the customer shall be provided with a scratch card which will contain a unique 12-digit code for Nigeria and 13-digit code for Ghana. The participants are required to SMS the 12 digit code to 38353 in case the participant is from Nigeria and the 13-digit code to7007 in case the participant is from Ghana.
5.2. In case of any defect in the scratch card, the participant should immediately contact the representatives of the Organizers on the help line number provided on the scratch card. The representatives of the Organizer shall inform the participant of the authenticity of the product and whether the participant is eligible for any reward or not.
5.3. The participant will not incur any additional charges in sending the SMS to the provided code.
5.4. The unique 12 or 13 digit code can only be used once. If the code is sent more than once then such entry shall not be considered and shall not be eligible for any prize.
5.5. The qualifying entries will be acknowledged by way of an SMS sent by the Organizer verifying that the participant has purchased a genuine and original LUX product and whether it stands a chance to win a prize in the Contest.
5.6. In case the participant does not receive a confirmatory reply due to network / technical failure or has any questions regarding the contest, the participant can contact the Organizer on the help line printed on the package of the product, being (+234) 803 901 2929 for resident of Nigeria and (+233) 302 745 200 for residents of Ghana.
5.7. There can be only 1(one) winner for each 12 or 13 digit unique number. Multiple entries will not be entertained. In case of multiple entries of one 12 or 13 digit number, the participant who send an SMS first or registers first shall be considered. However, incase of any fraud, the Organizer has the right to reject the winner.

6.1. It is understood that the purpose of the scratch card is primarily Free Authentication of a Genuine Lux Product and that this contest is merely an added benefit for the users of genuine Lux products and as such the mere participation in the Contest does not entitle the participant to a guaranteed win. The winners shall only be selected via a system generated algorithm and shall be intimated accordingly. It must be noted that the winner too shall only be declared so if the participant is a user of genuine and original LUX products. The scratch card must necessarily be obtained from the purchase of a genuine LUX product. Scratch cards obtained from counterfeit shall not be eligible for winning any prize under this Contest.
6.2. If the outcome of the Contest cannot be determined (due to technical failure or other circumstances beyond the Control of the Organizer and the data becomes irrecoverable), the Organizer may postpone the result or exclude the result from the system that failed, unless relevant data can be recovered.
6.3. If the Organizer cannot continue with the Contest for any reason beyond its reasonable control or if it is required by any regulatory terms or applicable law, the Organizer may end the contest and the same will be posted on the Organizer’s website i.e.
6.4. If the Contest ends as a result of the above mentioned two clauses (clauses 6.2. and 6.3.) no participant will have any claim of any nature whatsoever on the Organizer.
6.5. In the event that a participant wins Free Airtime, the same would be credited to the mobile number of the participant. The names of such winners can be displayed on the website of the Organizer. Once the participant is informed via SMS that he/ she has won Free Airtime, the credits will be transferred instantly to the mobile phones of the winners. However, the Organizer shall not be liable for any delay caused in transferring such credits if delays are caused to any problem with the mobile network.
6.6. The winners of the Grand Prizes shall be informed of the same via an SMS congratulating them on their win and the fact that they will be contacted in regard the same.
6.7. The grand prizes will be given to the Winners only upon presentation of the scratch card. The original scratch card must be presented and reproductions and copies of the same shall not be accepted.
6.8. The prizes in the Contest:
a) cannot be transferred and will only be handed over if all details given are factually correct and verified by the organiser;
b) cannot be exchanged for cash sums or for any prize other than the prize offered, save with the written consent of the organiser, which will be entitled to decline such request, without any obligation to furnish any reasons; and
c) may be replaced by another prize of the same commercial value if the original prize is not available for any reason beyond the Organizer's reasonable control.
6.9. The Organizer makes no representations and gives no warranties, whether express or implied, as to a prize, and in particular, but without limitation, makes no representations and gives no warranty –
a) that a participant's entry or participation will necessarily result in a participant winning a prize;
b) that a prize, or any aspect thereof, will meet a participant's requirements, preferences, standards or expectations; or
c) that a prize, or any aspect thereof, will be satisfactory, punctual, free from defects, safe or reliable
6.10. A participant may not win a prize if it is unlawful for the organiser to award such a prize. A participant who is denied a prize for such reason will forfeit it. It is the responsibility of a participant to make sure that he or she is not transgressing any law, regulation or rule, which may be applicable to the participant in entering this Contest.
6.11. The Grand Prizes shall be distributed by the online e-commerce company The call centre agents from the same shall call up the winners and inform them about their prize and also take their address so as to deliver the prize to them. The names of such winner along with their photograph, shall be displayed on the website of the Organizer and used for other marketing promotions.
6.12. The Organizer shall not be responsible for any harm, damage, loss or claim relating to the provision of any element of a prize or any changes to a prize that may be made at any time.

7.1. The organiser undertakes to comply with the local laws and regulations relative to the conduct of promotional competitions of any country where the competition or any part of is conducted. In this regard the organisers may rely where considered necessary on advice from appropriate advisers or consultants and will not be responsible for any defects, shortcomings or errors in any such advice which may adversely affect the conduct or continued conduct of the competition
7.2. If a section within these rules and regulations is declared or deemed illegal, unenforceable, or invalid by a competent court, such paragraph shall be considered void, but all other paragraphs that are not affected will be enforced to the extent permitted by law.
7.3. All disputes arising out of this agreement shall be adjudicated upon by an Arbitrator Tribunal consisting of three Arbitrators. The disputing parties shall each one appoint one arbitrator and the third arbitrator shall be appointed by the arbitrators appointed by the disputing parties. The place of arbitration shall be Kolkata, India. The decision of the Arbitration Tribunal shall be binding.

The organiser, including its subsidiary companies, directors, officers, shareholders, employees, agents, contractors and sub-contractors bear no responsibility whatsoever for any technical failure or malfunction or any other problem with any mobile network, system, server or service provider, software or otherwise which may result in any entry being lost or not properly received, registered or recorded or not being received on or before the appropriate closing time.
